Panel 1 : ICC Institutional Reform: Too Far or Not Far Enough?

The ICC Court has adopted a series of reforms to address users’ demands for enhanced transparency and predictability in arbitration. These reforms reflect broad questions about the role of an arbitral institution, the tools it has available to satisfy user demands and the appropriate degree of regulation. This panel will examine these questions through the lens of recent reforms at the Court, including: (i) publication of arbitrator names, including their nationality and method of appointment; (ii) revisions to the arbitrator’s availability statement and issuance of the Guidance Note on conflict disclosures by arbitrators; (iii) impact of delays on arbitrators’ fees; and (iv) providing reasons for certain Court decisions. This session will examine whether these reforms sufficiently meet the expectations of users or if the Court should go further, such as drafting conduct guidelines.

Panel 2: Parallel Proceedings: Taking Hostage of an International Arbitration

An international arbitration can be complex enough. What happens when other proceedings related to the same dispute also arise? Parallel arbitrations between the same or closely related parties, multiple arbitrations in a series of vertical contracts, civil suits in one or more courts and even criminal investigations and prosecutions have increasingly become companions to international arbitration. This panel will explore how international arbitration and other dispute resolution systems cooperate and sometimes conflict in addressing the many dimensions of a complex case.

Panel 3: Can We Handle the Truth About Witness Testimony?

Witness testimony is commonly presented in international arbitration. Yet cognitive science has demonstrated the fallibility of human memory, and how easily recollections can be distorted. This panel will explain the contemporary scientific understanding of witness recall, whether the implications of this research present a problem for arbitration and how arbitration practice might change to take into account what we have learned from cognitive science to improve arbitrators’ ability to reliably determine the facts.

Panel 4: Live from New York – It’s the ICC Court!

In celebration of the inaugural ICC Court plenary session to be held in New York City the day after the conference, members of the ICC International Court of Arbitration will lead this interactive mock plenary session in which each conference delegate will become a Court Member and can contribute to the deliberation on an arbitrator challenge.
